Petitioner is aggrieved by the fact that in spite of petitioner being deprived by the private respondent being the son, no steps have been taken by the police authorities. Petitioner has enclosed an intimation of the Sub-Divisional Officer. However, there is no order of the Sub-Divisional Officer for maintenance and/or any other directions under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. So far as the police authorities are concerned, the police authorities have already drawn up proceedings under section 126/135(3) of the BNSS, 2023 as also Magrahat PS Case No.

253/25 has been registered for investigation.

Learned advocate for the private respondent denies and disputes the accusations.

Be that as it may, if a specific order is passed by the SDO under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007, in that case, if directions are given to the police authorities, then only police authorities will act in a particular manner. For the time being, the steps taken by the police authorities are justified, as such no interference is called for. With the aforesaid observations WPA 15848 of 2025 is disposed of.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
