Heard learned counsels for the parties.
Learned counsel for the petitioner submits that the petitioner is in custody for more than 10 months. He has been implicated on the basis of statement of co accused. No independent evidence has been gathered against him. The de facto complainant is being examined and has not implicated him.
Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner along with others appears to have duped the victims into opening several bank accounts with an assurance of arranging for educational loan and have siphoned huge amount of money from their accounts. Bail prayer of the co accused was turned down by this Court earlier. The petitioner appears to be similarly placed with
them. Out of 9 witnesses, one witness is being examined at present.
Considering the nature of the offence and extent of involvement of the petitioner therein, prayer for bail is rejected at this stage.
However, the learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is thus disposed of. Case diary be returned.
