Learned advocate appearing for the petitioners submits that they have been thrown out from their own house by the respondent nos.5 and 6 who happen to be the son and the daughter-in-law. Learned advocate for the State has submitted a report. Let the report be kept with the record. Report reflects that cases under Section 107 of the Code of Criminal Procedure being drawn up by the police authorities.
In view of the primary concern of the petitioners, I direct that the Officer-in-Charge,
Garhbeta Police Station would take steps by deputing a lady police personnel who would escort the petitioners at their own residence. There would be further direction upon the lady police personnel who would every alternate day for a period of four weeks visit the house and assess as to whether the present petitioners are subjected to any harassment or humiliation. Such arrangement would continue for a period of four weeks within which the petitioners would approach the appropriate authorities under the provisions of Maintenance and Welfare of Parents and Senior Citizen Act, 2007. In case the concerned tribunal passes any order, the police authorities would adhere and abide by the said order passed by the tribunal.
As prayed for, petitioners would approach the Officer-in-Charge, Garhbeta Police Station on 3rd December, 2024 when the Officer-in-Charge would act in accordance with directions passed above. With the aforesaid observations, WPA 16921 of 2024 is disposed of.
There will be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
