Learned Counsel appearing for the petitioner submits he is in custody for more than one year. Learned Counsel also submits recovery below commercial quantity was made from the petitioner.

Learned Counsel appearing for the State opposes prayer for bail. He submits 100 pieces of Yaba Tablets were recovered from the residence of the petitioner. Co-accuseds were apprehended with 5000 pieces of Yaba Tablets. We have considered materials on record. Substantial recoveries was made from the petitioner and co-accused persons. Materials on record give rise to a prima facie inference that petitioner and co-accuseds were acting in concert with one another in trafficking Yaba Tablets.

In view of the aforesaid incriminating materials and nature of offence, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
