Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioners are aggrieved by the fact that in spite of an undertaking given by the private respondent before the civil court, unauthorised construction has been proceeded with.

State has submitted a report. According to the State there has been some repairing works carried out at the behest of the private respondent and apparently there has been no illegal construction. However, the police authorities have informed the Kolkata Municipal Corporation.

In case the Executive Engineer (Building), KMC finds that there has been violation and unauthorised construction, in that case appropriate complaint be sent to the Officer-in-Charge, Amherst Street Police Station who would take steps in accordance with law.

The petitioner submits that on the basis of complaint of KMC, a case has already been registered with Amherst Street Police Station. If a case has already been registered and investigated, the police authorities would in that event take the investigation of the said proceeding to its logical conclusion within a reasonable period of time. With the aforesaid observations, the writ petition being WPA 16800 of 2024 is disposed of. There shall be no order as to costs.
