Citing the inaction of the District Inspector of Schools in not considering the petitioner's application for grant of a higher scale of pay, the present petition has been preferred. 2.

Mr. Ali, learned advocate representing the petitioner, submits that the petitioner joined Balia Nafar Chandra Balika Vidyalaya (HS) (hereinafter referred to as 'the said School') as an Assistant Teacher in Mathematics on 8th July, 2011. Subsequently, the petitioner made an application before the Managing Committee of the School through its Headmaster, seeking permission to improve his qualification in the subject relevant to his teaching.

The Managing Committee, while adopting a resolution, accorded such permission. The petitioner obtained an M.Sc. degree in Mathematics from Manonmaniam Sundaranar University, Tamil Nadu, in 2013. After obtaining the M.Sc. degree in Mathematics, the petitioner made an application to the District Inspector of Schools through proper channel, praying for the grant of a higher scale of pay due to the

improvement of his qualification in the subject relevant to his teaching. However, despite receiving such application from the petitioner, no steps have been taken.

Despite service of the notice, the State is unrepresented.

Having heard the learned advocate appearing for the petitioner and upon perusal of the materials on record, it appears that the application presented by the petitioner, seeking the benefit of a higher scale of pay which was forwarded to the District Inspector of Schools by the Managing Committee, is still pending consideration. The District Inspector of Schools cannot sit tight over the matter for an indefinite period.

In view of the above, the writ petition is disposed of by directing the District Inspector of Schools to take a decision on the application of the petitioner, submitted for grant of a higher scale of pay in favour of the petitioner due to his improvement in qualification, after affording the petitioner an opportunity of hearing.

If the District Inspector of Schools finds merit in the petitioner's contention, appropriate follow-up steps shall be taken. If the District Inspector of Schools finds that the petitioner's contention is without substance, a reasoned order shall be passed and the same shall be communicated to the petitioner. The entire exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is, thus, disposed of.

There will be no order as to costs.
