The petitioners are alleging that the petitioners and the private respondent nos. 6 to 10 are the members of five different Self-Help Groups set up for the supply of Cook-cum-helper in the Mid-Day-Meal Programme of Faridpur High School (H.S.), P.O.-Faridpur, District: Murshidabad, but the private respondents suppressing the said fact, has obtained an order in W.P.A 28353 of 2022(Rangila Bibi & Ors. Vs. State of West Bengal & Ors.) to get the remuneration from the authority directly in their bank accounts, in consequence thereof, the said respondents are getting the work and remuneration in exclusion to the petitioners.

The petitioners are praying direction upon the school authority for allotment of work to them in the said Mid-day-Meal programme.

Mr. Rezaul Hossain, learned advocate for the State files a statement of facts of the Block Development Officer, Jalangi Block, District:

Murshidabad bearing Memo No: 1884/EN dated July 17, 2023.

It appears from the said statement that the petitioners not being the listed Cook-cum- helper in connection with the said Mid-Day-Meal Programme are not entitled to assignment of any work.

That being the position, the petitioners are not entitled to the leave as prayed for.

WPA 15902 of 2023 is dismissed without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
