1. This contempt application has been filed for alleged disobedience of the order and direction issued in the judgment dated 21.06.2024, more particularly, the direction in paragraph 34 wherein the court was not inclined to permit the first respondent or any suspended office bearer to operate the bank account of the West Bengal branch.

2. According to the alleged contemnors two persons who were not suspended members, have been nominated to operate the bank account.

3. Learned advocate for the applicant refers to a resolution taken by the Central Body in its meeting convened on 22.06.2024. In the said meeting there

has been a unanimous decision nominating an interim Honourary Secretary and interim Treasurer of the West Bengal branch to operate the bank account.

4. However, this was not the scope of the direction contained in paragraph 34 of the order and as of now since two non-suspended members have already been nominated, we find that there is no willful disobedience of the order and direction of the judgment dated 21.06.2024.
