Bhattacharyya Ms. Sujata Ghosh ... for the State Ms. Anima Chakraborty ... for the respondent no.8 Mr. Sudarsan Roy ... for the Municipality The writ petition was filed challenging inaction of the authority in implementing the order dated June 30, 2021, passed by the Chairperson, Board of Administrators, North Dum Dum Municipality. It is submitted that the factory of the respondent No.8 is still operating despite there being an order of the authority.

The report prepared by the Trade Licence Department of the North Dum Dum Municipality, is taken on record. It appears that the alleged factory of the respondent no.8 has been stopped subsequently and the same is not operating.

As the municipality has filed a report, from which it appears that the alleged factory is not running at present, no further order need be passed,

save and except that the municipality shall ensure that such factory shall not operate unless all legal compliances are fulfilled.

The respondent no.8 shall not operate the said factory except in accordance with law and upon obtaining due permission from all the permission granting authorities, as required by law.

With the above observations, this writ petition is disposed of.

There shall be no order as to costs.
