And In Re : Abbasuddin Sk. ..... petitioner Mr. Goutam Misra ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Trina Mitra ... for the State Learned Counsel appearing for the petitioner submits that the petitioner is in custody for 411 days. He prays for bail. It is also submitted that co-accuseds are on bail. Learned Counsel appearing for the State opposes prayer for bail.

We have considered the materials on record including statements of the eye-witnesses recorded under Section 164 of the Code of Criminal Procedure. Petitioner is one of the accused persons who assaulted the victim resulting in his death. Prayer for bail of Ekramul Hossain Sk. who is similarly circumstanced with the petitioiner, was turned down by this Court. In view of the aforesaid incriminating materials on record and gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
