The facts of the case related to recovery of 27600 bottles of phensedyl. The petitioner is in custody for one year and two months and the case records reveal that out of eight accused persons who have been chargesheeted, one of the accused is still absconding. The case has been split up and charges have been framed on 17.11.2025. It has been submitted on behalf of the State that the evidence would commence from the next date so fixed.

Having considered the huge volume of the phensedyl, I am of the opinion that the rigors of Section 37 of the Narcotics Drugs and Psychotropic Substances Act, 1985 is attracted. It would not be fit and proper to release the petitioner on bail.

Consequently, CRM(NDPS) 902 of 2025 is dismissed. 4.
All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court. 5.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
