The Court, at the outset, takes the opportunity to extend its appreciation to learned counsel for the West Bengal State Electricity Distribution Company Limited (WBSEDCL), who exercised his good office and impressed upon his client that some installments may be granted to the petitioner in view of the plight of the petitioner. Accordingly, a communication is handed over in Court today, which expresses the willingness of the Distribution Licensee to grant three installments for making payment for the entire assessed amount, including Late Payment Surcharge (LPSC), without creating any
precedence. The communication filed in Court be kept on record.
Accordingly, WPA No. 15921 of 2023 is disposed of on the basis of the said communication of the WBSEDCL, by granting three equal monthly installments to the petitioner to make the payment of the entire assessed amount, including LPSC. The first of such payment shall be made by the 31st day of this month and the next installments shall be made by the 31st day of each of the succeeding months. Upon the first installment being paid, the WBSEDCL shall restore the electricity connection of the petitioner. However, such restoration shall be subject to further disconnection in the event the petitioner fails to pay further installments. Nothing in this order shall prejudice the rights of the WBSEDCL to take appropriate steps in accordance with law in the event there are subsequent defaults on payment of installments. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
