This is an application for recording the death of the petitioner no. 1/Bhamari Devi Srimali who died intestate during the pendency of the present revisional application on October 13, 2020.

The heirs of the deceased petitioner no. 1 are already on record, as such the death of the petitioner no. 1 be recorded. The department is directed to carry out necessary amendment in the cause title of the revisional application. CAN 1 of 2021 is thus disposed of. No order as to costs.

Mr. Vinay Kumar Purohit, learned counsel appearing for the petitioners, submits that his clients do not want to proceed with the present revisional application and he files written instruction of his clients to the said effect.

CO 2591 of 2019 is therefore dismissed as not pressed. No order as to costs.

The written instruction of the clients of Mr. Purohit be kept with the record.

The learned Trial Judge is requested to expedite the hearing of the connected suit.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
