Petitioner has submitted a representation with the Superintendent of Police, Sundarban Police District on 11.06.2024.

Learned advocate for the state submits that already a case has been registered.

Records reflect that the petitioner and private respondents are relations.

Having considered the nature of accusations made by the petitioner with the Superintendent of Police, Sundarban Police District, I am of the view that some of the accusations are in respect of a particular act which was not in the domain of the investigation.

Accordingly, the Superintendent of Police would consider regarding the applicability of the Special Act and take steps in accordance with law.

If the Superintendent of Police is of the opinion that no cognizable offence is made out and/or that it is not possible for his office to take any steps, he would inform the same within a period of 4 weeks from the date of communication of this order to the petitioner.

Petitioner would thereafter be at liberty to approach the jurisdictional magistrate under the relevant provisions of law.

With the aforesaid observations WPA 16848 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
