........petitioner Ms. Anasuya Sinha, ... for the State Petitioners herein filed this application seeking quashing of FIR being BDN (N) P.S. Case No. 106 of 2015 dated 2.5.2015 under Section 365 of the Indian Penal Code and the Proceeding thereof.

Nobody appears on behalf of the petitioners. Status report filed by the State is taken on record. It appears from the record that the learned Magistrate has accepted the FRT submitted by the Investigating Officer and accepted dispose of the case since the de facto complainant found absent without any step and de facto complainant has not appeared before the learned Court below on several dates in spite of giving opportunity of hearing to the de-facto complaint.

Accordingly, the instant case become infructuous, when they charge sheet ended with F.R.T.

Consequently, CRR 2077 of 2015 is, thus, dismissed being infructuous.

Let a copy of this order be sent to the learned Court below for information.

Urgent xerox certified copy of this order, if applied for be given to the learned advocate for the parties on usual undertakings.
