This is an application under Section 482 of Cr. P.C., 1973 filed by the petitioner for quashing of the proceedings of G.R. Case No.468 of 2004 pending before the learned Additional Chief Judicial Magistrate Serampore, Hooghly arises out of Rishra Police Station Case No.40. of 2004 dated 19.05.2004 under Sections 498A/406 of the Indian Penal Code. The matter first appeared before the Coordinate Bench on July 7, 2015 when on the prayer of the petitioner the matter was directed to go out of list. Subsequently, in February, 2025 two weeks' time was prayed for on the ground of Mr. Milan Kumar Mukherjee, learned senior Advocate. Ms. Sukanya Bhattacharya, learned Advocate assisted by Ms. Sana Naaz, learned Advocate was requested to appear in this matter on behalf of the State and their appearance was directed to regularize by the learned Legal Remembrancer.

A copy of the revisional application was served upon the State on 01.05.2025.

Considering the above facts and circumstances that the matter is pending since 2015, this Court finds no reason to allow the matter to be pending in the list further.

Accordingly, the matter stands dismissed for default.

Let a copy of this order be sent to the learned trial Court immediately.
