Admittedly, petitioner/defendant no.3 has been suffering ad interim order of injunction granted by this Court. Petitioner/defendant no.3 has already filed written objection against the ad interim order of injunction being granted by the court below. Apart from filing the written objection, petitioner/defendant no.3 also filed an independent application praying for injunction, which is kept pending.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

Accordingly, learned Civil Judge (Junior Division), 2nd Court, Barrackpore, North 24 Parganas, in Title Suit No.113 of 2022 is requested to ensure expeditious disposal of an application filed by the petitioner/defendant no.3 praying for injunction without granting unnecessary adjournment, unless it is extremely unavoidable, preferably within a period of three months from the date of communication of this order.

While endeavouring such exercise, preponement of date if needed, may be considered by the court below upon notice to the other sides, so that the injunction application filed by the petitioner/defendant no.3 may be expeditiously disposed of.

Petitioner/defendant no.3 is directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.

With this observation/direction, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
