The petitioner complains that his wife, son and daughter-in-law have inflicted torture on him and as a consequence he has been driven out from his house. The counsel for the State has produced a report in the form of instructions issued by the Inspector of Police, O.C., Dum Dum Police Station Barrackpore Police Commissionerate dated 15th November, 2021 to the Government Pleader and the same is taken on record. It appears from the said report that the petitioner is voluntarily residing with another lady with whom he has a relationship. Since after the said relationship, there has been bad-blood between the petitioner and his other family members.

This Court is of the view that there is no inaction on the part of the police as cases have been registered by the respondents against the petitioner and vice versa. There are also proceedings pending before the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

It is, therefore, ordered that the proceedings before the Maintenance Tribunal should be completed as expeditiously as possible upon due notice to all the parties. With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
