1. This is an attempt to re-open the judgement passed by this Court in MAT 1017 of 2025 [Arunima Paul & Ors. vs. State of West Bengal & Ors.] & MAT 1026 of 2025 [Bibek Paria & Ors. vs. State of West Bengal & Ors.]. We have unequivocally stated that the increasing the eligibility criteria from 45 to 50 percent is a policy decision of the Government which we do not find to be arbitrary having regard to the nature of recruitment and the duties to be performed by the teachers to be appointed for the post of assistant teachers in Classes IX - XII.

2. Learned counsel appearing on behalf of the appellants has submitted that the criteria fixed by the Commission is not in

accordance with NCTE guidelines. The vires of Rules 2025 is not under challenge.

3. Moreover, we are unable to accept the submission of Mr. Dasgupta in view of our definite findings on the issue discussed in Arunima Paul (supra). In view thereof, we are not interfering with the judgement passed by the learned Single Judge.

4. The appeal and the application stand dismissed without any order as to costs.
