The writ petitioners complain that the private respondents being the younger son and daughter-inlaw have thrown them out of the residence. The private respondents being the younger son and daughter-inlaw claim that the petitioner no. 1 was never the owner of the property.
It is submitted that the property was in the name of the wife of the petitioner no. 1. It is also submitted that a false statement has been made on affidavit that the petitioner no. 1 is not employed. The petitioner no. 1 is a pensioner.
Counsel for the State submits that the petitioner no. 1 and his elder son on one side and the younger son and daughter-in-law on the other side have been at loggerheads and there is a severe family discord. The private respondents allege that the petitioner has killed his wife.
Admittedly, as may as five complaints have been filed by the private respondents against the petitioners
and six complaints have been lodged against the private respondents. Some of such complaints have resulted in charge sheets and the others are pending investigation. There is therefore no inaction on the part of the police This Court is of the view that no interference is called for under Article 226 of the Constitution of India since these are private family disputes.
For the reasons stated herein above, the writ petition is dismissed.
There will be no order as to costs.
