The affidavit-of-service as filed today on behalf of the writ petitioners is taken on record.

At the time of hearing, Mr. Bhattacharya, learned advocate appearing on behalf of the 18 writ petitioners submits before this Court that he undertakes to file requisite court fees for 17 numbers of writ petitioners positively by September 9, 2025 in the department. 3.

In view of such, Department is directed to accept requisite court fees for 17 numbers of writ petitioners if filed by the writ petitioners and/or their learned advocates on record in connection with the instant writ petition.

By filing the instant writ petition, the writ petitioners have prayed for issuance of appropriate writ/writs against the respondents, more specifically, against the respondent no. 3/authority commanding them to take appropriate steps for payment of the adequate compensation in connection with L.A. Case No. LAII/58 of 1979-80 by applying the provisions of Act XXX of 2013.

At the time of hearing, Mr. Bhattacharya draws attention of this Court to Page Nos. 47 to 57 of the instant writ petition being several representations as submitted by the writ petitioners with the respondent no. 3/authority requesting him to disburse adequate compensation in connection with the acquisition of land in the aforementioned L.A. Case No. LA-II/58 of 197980. 6.

In course of his submission, Mr. Das, learned advocate appearing on behalf of the respondent/State has submitted a report dated 29.07.2025 as prepared by the respondent no. 3/authority. It is submitted by Mr. Das that from the report as filed today and as has been taken on record, it would reveal that in connection with the aforementioned L.A. case, payment has been made in terms of the Award No. 01 to 25. It is further submitted by Mr. Das that from Annexure-C to such report indicates reveal the particulars of the land losers who have received the award.

On comparative study of the names of the awardees as available at Annexure-C to such report as filed today, this Court prima facie does not find the names of the present writ petitioners except one i.e., Uttam Naskar, the writ petitioner no. 3.

In view of such, this Court while disposing the instant writ petition directs the respondent no. 3/authority to consider the representations of the writ petitioners as have been annexed at Page Nos. 47 to 57 to the instant writ petition in accordance with law and after giving due

opportunity of hearing to the writ petitioners as well as any other stakeholders, if therebe any, shall pass a reasoned order in accordance with law and to communicate the same to the writ petitioners forthwith. 9.

The entire exercise as indicated hereinabove is to be completed by the respondent no. 3/authority within 120 working days from the date of communication of the server copy of this order.

10. The time limit as fixed by this Court is mandatory and peremptory.

Liberty is given to the learned advocate on record for the writ petitioner to communicate the server copy of this order to the respondent no. 3/authority.

The respondent no. 3/authority is hereby directed to act on the basis of the server copy of this order. 13.

With the aforementioned observations, the instant writ petition being WPA 15951 of 2025 is disposed of. 14.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
