1. We have heard the learned advocates for the parties.

2. The learned Single Judge was of the view that the writ petition has made misleading statement and the ground for transfer as argued and stated in the writ petition are at variance. Hence dismissed the writ petition.

3. We are of the view that the learned Single Judge was justified in dismissing the writ petition.

4. Learned counsel appearing on behalf of the appellant submits that if the writ petitioner has justifiable ground for transfer in accordance with the relevant provision, he may be permitted to file such writ petition.

5. In our view the right to file a writ petition in justification for transfer of the writ petitioner is not precluded by the impugned order.

6. The appeal and the application are dismissed without any order as to costs.
