The petitioner is aggrieved by the manner in which proceedings under Section 138 of the N. I. Act are proceeding before the learned Metropolitan Magistrate, 15th Court, Calcutta. The grievance of the petitioner is that the complaint was filed on 17th February, 2017 and after 5 and 1⁄2 years, the crossexamination of the prosecution witness no.2 is still continuing. It has been alleged that the accused persons are purposely delaying the trial. Having regard to the contentions made by the petitioner and the period, which has already lapsed, I am of the opinion that the proceedings must be disposed of expeditiously. Accordingly, the learned court should fix at least one date in each and every month for the instant case and take all efforts to conclude the proceedings. With the aforesaid observations, the revisional application being CRR 2635 of 2022 is disposed of.
