Bhattacharya ...for the Petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 1st Court at Jangipur to dispose of the Matrimonial Suit No. 29 of 2021 expeditiously.
The learned Advocate appearing for the petitioner submits that the suit is at the evidence stage. She further submits that the wife/opposite party is trying to delay the hearing of the matrimonial suit.
In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned Advocate-on-record for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned
advocates representing the opposite party before the learned Trial Judge.
From the order-sheets appended to this application, this Court finds that 7th of April, 2025 was fixed for evidence.
The learned Advocate appearing for the petitioner submits that 25th July, 2025 has been fixed for recording evidence of P.W. 1.
In the light of the submissions made by the learned Advocate for the petitioner CO 2534 of 2025 stands disposed of by requesting the learned Additional District Judge, 1st Court, Jangipur to make an endeavour to see that the Matrimonial Suit No. 29 of 2021 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties provided the petitioner is not in default in payment of alimony and maintenance. With the above observations CO 2534 of 2025 stands disposed of.
