Affidavit of service filed on behalf of the petitioners be taken on record.

It is submitted on behalf of the petitioner that she filed an application before the respondent No.2 for allotment of vacant land adjacent to her house and permission to maintain the said land by planting trees thereon. The said application is yet to be disposed of. The petitioner refers to Section 8(2) of the West Bengal Highways Act, 1964 and prays for a direction upon the authority to consider and dispose of the application filed by the petitioner in terms of the said provision of law.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of with a direction upon the 2nd respondent to consider and dispose of the application filed by the petitioner dated 10th September, 2021 within a period of three months from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

With the above observations and directions this writ petition WPA 17151 of 2021 is disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
