The petitioners claim that they lie in the same footing as that of the petitioners in WPA 17493 of 2023 (Rehana Khatun -Vs- State of West Bengal & Ors) and claim same benefit as granted by this Court in the said matter on 22.09.2023.

In view of the above, the instant writ petition is disposed of by directing the concerned respondents to allow the petitioners to be treated as Sahayikas in their respective Sishu Siksha Kendras ignoring the options exercised by them under the notification of the Government of West Bengal, School Education Department, Elementary Education Branch bearing Memo No. 979-ES /EE/10M-164/19 dated December 18, 2019 and to allow them to continue for their engagement upto the age of 65 years.

The petitioners will not be entitled to the benefits available to the para teachers.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
