Mr. Kallol Mondal Mr. Souvik Das ....for the petitioner Mr. J.L. De Mr. Abdus Salam ..for the State Pursuant to an advertisement dated February 10,2020 published by the Sub-Divisional Officer & Member Secretary of ASHA Selection Committee, Malda Sadar, Malda, the petitioner applied for the post of "ASHA". The petitioner appeared at the interview on September 28, 2020. The contention of the petitioner is that the authorities failed to publish the result of the interview process. Thereafter, suddenly, the respondent no.11 was appointed arbitarily and with mala fide motive, although the respondent No. 11 was not eligible.

Mr. De, learned advocate for the State respondents submits that the entire interview process was reached to its logical conclusion. The result was published. The panel of selected candidates was approved by the competent authority. The respondent no.11 was selected as the successful candidate. The respondent no.11 has already joined the post.

The petitioner prays that as the petitioner has raised an objection with regard to the selection of the respondent no.11, the same must be disposed of. Allegation is that as per terms and conditions of the advertisement, the respondent no.11 must be disqualified as the said respondent belonged to a different village and was not a resident of the same service village, in respect of which the appointment was made.

The complaint of the petitioner filed before the Sub Divisional Officer, Malda, must be disposed of upon hearing the petitioner, the respondent no.11 and any other persons involved in the selection process.

A reasoned order shall be passed and communicated to all concerned.

The entire exercise shall be completed within a period of three months from the date of communication of this order. This court has not entered into the merits of the case of the petitioner.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
