The petitioners pray for bail on the ground that they have not been implicated in the present matter.
Opposing the prayer, learned counsel for the State submits that the 4th petitioner has a criminal antecedent to his credit. I have considered the material on record. Besides the names of the petitioners appearing in the written complaint, there is no prima facie material which has transpired against them in course of investigation.
Considering the extent of complicity of the petitioners in the alleged offence, this Court is of the view that their further detention is not required and they may be released on bail. Accordingly, their prayer for bail is allowed. The petitioners namely Sadrul Amin, Rabiul Sk. @ Rabiul Alam, Emaj Sk. @ Emajuddin and Asha Sk. @ Ashadur Rahaman be released on bail upon furnishing bond of Rs.10,000/- (Rupees ten thousand only) each, with two sureties of like amount each, one of
whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad, subject to the condition that they shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event these petitioners fail to appear before the learned trial Court on any date without any justifiable cause, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
