Petitioner is aggrieved that the vested land is being enjoyed by the private respondents.

On the other hand learned advocate for the State has submitted a report which reflects that there was a title suit over the said property being T.S. 208/2017 which was dismissed on contest on or about 30.11.2016, the same was appealed and Title Appeal no. 05/2017 was dismissed on 20.07.2018 by the learned Additional District Judge, 3rd Court, Barrackpore. There has been a specific direction of the Executive Magistrate also restraining the petitioner and others of Annapurna Gate No. 01 to abstain from entering the scheduled property. Having considered that the petitioner along with his associates are well aware regarding the issue being

decided by the Civil Court they/he are unnecessarily approaching the Writ Court. The primary grievance of the petitioner relates to vesting of the land.

Be that as it may, if the petitioner intends to pursue, he will approach the land authorities and police authorities would act if the concerned officer of the land department informs necessary offences having been committed. No interference is called for by this Court. With the aforesaid observations WPA 15969 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
