Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 86 days. It is submitted he has been falsely implicated in the instant case. Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record including the statements of the tea stall owner Mantu Gayen and one Mato Sk. Both the witnesses disclosed role of the petitioner in the murder.

In view of the aforesaid incriminating materials on record and the gravity of offence, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
