Mr. Supriyo Chattopadhyay Ms. Iti Dutta ... for the State The petitioner, an assistant teacher of a primary school, was placed under suspension by the Hooghly District Primary School Council by an order dated 18th January, 2021. The order of suspension mentions that the suspended teacher will get subsistence allowances during the period of suspension.

It is the specific case of the petitioner that he is not getting subsistence allowances from the date of his suspension.

None appears on behalf of the Hooghly District Primary School Council. Affidavit of service is taken on record.

As it appears that the order of suspension issued in respect of the petitioner clearly mentions about payment of subsistence allowance during the period of suspension accordingly the instant writ petition is disposed of by directing the respondent No.

3 being the Chairman, Hooghly District Primary School Council to take steps for payment of subsistence allowance to the petitioner strictly, in accordance with the provisions of law.

The aforesaid respondent shall take all endeavour to see that the subsistence allowance is released in favour of the suspended teacher at the earliest but positively within a period of eight weeks from the date of communication of a copy of this order after compliance of all necessary formalities. The writ petition stands disposed of.

Affidavit of service filed in court today is taken on record.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
