Mr. Sakti Pada Jana Ms. Sudipta Pramanick ...for the petitioner Mr. Kshetra Prasad Mukhopadhyay ...for the State Supplementary affidavit has been filed in terms of the leave granted by this Court vide order dated 2nd September, 2024 today and the same is taken on record. Petitioner's husband was headmaster of a Government recognized aided school who died in harness on 19th August, 2017.

After death of the husband of the petitioner Pension Payment Order was issued on 20th June, 2022 thereby releasing terminal benefits including family pension in favour of the petitioner. Petitioner prays for interest on gratuity due to delayed payment.

State-respondents are represented by learned advocate.

Accordingly, Director of Pension, Provident Fund and Group Insurance and the concerned Treasury Officer are directed to pay interest @ 8% per annum to the petitioner on gratuity from the date following the date of death of husband of the petitioner till the date of

payment, within a period of 8 (eight) weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
