PP Ms. Sujata Das ...for the State Mr. Mukherjee, learned Public Prosecutor submits that the documents which were handed over for verification, has been assessed by the Investigating authority from the office concerned and the authenticity of the said documents have been found to be genuine. As such, a supplementary charge-sheet has been filed before the jurisdictional court thereby deleting the offences under the Foreigners Act.

Mr. Lahiri, learned advocate for the petitioner submits that the petitioner is in custody for 138 days. In view of the fact that the petitioner has a permanent abode in India and having regard to the nature of the offences complained of, this court is inclined to release the petitioner on bail on definite terms and conditions.

The petitioner, namely, Jamuna Mandal @ Jamuna Sanaq shall furnish a bond of Rs. 10,000/- (Rupees ten thousand only),

with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Basirhat.

The petitioner shall attend the office of the learned Additional Chief Judicial Magistrate, Basirhat once in a fortnight and obtain an acknowledgment from the concerned officer of the said department.

The police authorities would submit a report once a month before the learned Additional Chief Judicial Magistrate, Basirhat regarding the availability of the petitioner at the residence furnished before the Court.

The Investigating Officer of the case is present in Court. His personal appearance is dispensed with.

Accordingly, CRM 6784 of 2021 is allowed.
