Ms. Gopa Biswas ......for the petitioner Affidavit of service filed on behalf of the petitioner is taken on record.

The writ petition pertains to release of arrear dues due to sanction of postgraduate scale of pay in favour of petitioner on acquiring higher qualification vide memo dated 17th April, 2017.

Vide another memo dated 2nd September, 2019, Additional District Inspector of Schools (SE), Chandannagar Sub-Division, Hooghly forwarded the arrear bill for release of arrear dues in favour of the petitioner to the District Inspector of Schools (SE), Hooghly.

Grievance of the petitioner is in spite of preparation of arrear bill and the same was forwarded to the concerned District Inspector of

Schools, till date arrear dues have not been cleared in her favour.

State respondents are not represented.

Having considered the submission made on behalf of the petitioner and taking note of the relevant materials available on record, it appears that postgraduate scale of pay was sanctioned in favour of the petitioner vide memo dated 17th April, 2017 and petitioner is in receipt of salary in postgraduate scale of pay from the month of April, 2017.

However, according to arrear bill prepared by the concerned Additional District Inspector of Schools (SE), it appears that petitioner is entitled to receive arrear dues accrued due to difference of pay on sanction of postgraduate scale of pay for the period from 19th December, 2003 till 31st March, 2017 and accordingly the said bill was submitted vide memo dated 2nd September, 2019 to the District Inspector of Schools (SE), Hooghly and subsequent thereto no steps have been taken for releasing such arrear dues.

In view of aforesaid facts, concerned District Inspector of Schools (SE), Hooghly being the respondent no. 3 is directed to release arrear

dues in favour of the petitioner by four weeks from the date of communication of this order if the petitioner is entitled to receive such benefits in accordance with law.

Accordingly, the writ petition stands disposed of.

However, there shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
