M/L. 95 Rakib (Rejected) CRM (NDPS) 892 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gazole Police Station Case No. 574 of 2024 dated 15.07.2024 under Sections 21(C) of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for one year three months and although charge-sheet has been submitted but till date none of the witnesses have been examined, although, the prosecution proposes to examine 11 witnesses.

Learned advocate appearing for the State opposes the prayer for bail and submits that commercial quantity of contraband was recovered from the possession of the petitioner (322 gms of Brown Sugar).

Having regard to the stage of the case that charge has already been framed, I direct the learned Special Court to take steps to at least conclude the examination of 6 witnesses by 15th of February, 2026.

The learned advocates for the respective parties would cooperate with the learned trial Court and the trial of the case would continue in spite of any resolution of the local Bar. Presently CRM (NDPS) 892 of 2025 is dismissed. Petitioner would be at liberty to approach this Court and renew the prayer for bail if there is non-compliance of aforesaid conditions.

Liberty is granted to the learned advocate for the State of communicate server copy of this order to the learned Special Court.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
