At the time of call, an adjournment is called for on behalf of the petitioner. I find no justification to adjourn the hearing.

After hearing the learned advocate for the State, I dispose of this writ petition.

The petitioner claims ownership in respect of Dag No.649 and 801, Khatian No.227, J.L. No.45 under Mouza Khapur, Police Station Haripal, Hooghly, by virtue of an oral transfer from his maternal grandmother. Petitioner alleges that respondent nos.9 and 10 are making construction on the said plots defying his ownership.

There is no scope to adjudicate the title of the parties in this writ petition.

It appears that petitioner has already filed a title suit against the respondent no.9 before a competent Civil Court in respect of relevant property.

Accordingly, WPA 16429 of 2022 is dismissed.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
