13.08.2024 rc/ct.no.34 Item No.146 CRR No. 2714 of 2024 In the matter of : Amit Kumar Bhowmick .......Petitioner Mr. Abhirup Chakraborty Mr. Tuhin Ganguly ...for the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of the complaint case no. 917C of 2019 pending before the learned Judicial Magistrate, 2nd Court, Malda, the matter may be disposed of without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the matter. Learned counsel for the petitioners submits that the complaint case was received by the learned Trial Court for disposal on December 13, 2019 and upon examination of the complainant under Section 200 of the Code of Criminal Procedure process was issued. Since the opposite parties/accused persons did not appear upon service of summons, warrant of arrest was issued against them vide order passed on October 20, 2022. The opposite parties have not surrendered before the learned Trial Court and date was fixed for execution return on August 21, 2024.

Since the matter is pending before the learned Trial Court from 2019, the learned Trial Court is directed to exhaust the

procedure for securing the attendance of the opposite parties/ accused persons before him and dispose of the case as expeditiously as possible without granting any unnecessary adjournment to either party, in accordance with law. CRR No. 2714 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
