1. We have heard Mr. Nayan Rakshit, learned advocate for the applicant and Mr. Diptomoy Talukder, learned advocate for the alleged contemnor/respondent. The amount, which was computed by the Labour Court in an application filed under section 33 (2)(c) of the Industrial Disputes Act has been settled and a banker's cheque for a sum of Rs.

7,97,838.56(Seven Lakh Ninety Seven Thousand Eight Hundred Thirty Eight and Paise Fifty Six ) only dated 5th June, 2023 drawn in the name of the applicant Tanmoy Mitra has been handed over to Mr. Nayan Rakshit, learned advocate appearing for the applicant.

It is submitted by the learned advocate appearing for the applicant that till the appeal was disposed of, the applicant is entitled for wages under section 17B of the Industrial Disputes Act. This has been calculated to a sum of Rs. 1,50,000/-.

There will be a direction to the respondents to settle the wages payable under section 17B of the Industrial Disputes Act during the pendency of the appeal and continue to pay the same till the appeal is disposed of.

This direction be complied with within a period of four weeks from the date of receipt of server copy of this order.

With the above direction, the contempt application stands disposed of.

6. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
