Learned counsel for the petitioner submits that the petitioner is not the principal assailant and was only allegedly present at the time of occurrence.

Learned counsel for the State opposes the prayer. I have considered the material on record. Five out of twelve witnesses have been examined so far. Two of the witnesses have implicated the petitioner. The petitioner is in custody for close to four years. Offence, if proved, shall attract mandatory life imprisonment.

Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties, in accordance with law.

The bail application is disposed of.
