Mr. Tapan Kumar Mukherjee ...for State It appears that the petitioner is aggrieved by the inaction of the Officer-in-Charge, Habibpur Police Station. The allegation is that a large number of trees under the Dhumpur Gram Panchayat have been destroyed, damaged and felled, without necessary permission under the relevant laws. A complaint was lodged before the concerned police authorities and also the Divisional Forest Officer, Malda.

It is the contention of the petitioner that the Pradhan, Dhumpur Gram Panchayat obtained permission for felling of some trees, but such large scale damage to the trees in the locality had not been authorized by law or by any competent authority. As the office of the Divisional Forest Officer is already in seisin of the matter, the court deems it fit to direct the petitioner to approach the said officer with a detailed complaint.

It is expected that the petitioner's complaint to the Divisional Forest Officer, Malda shall be disposed of expeditiously, as per law.

The police authorities, if required, shall act on the basis of any further direction if given by the Divisional Forest Officer.

The writ petition is accordingly disposed of. There shall be no order as to costs.
