Learned advocate appearing for the petitioner complains that in spite of informing the police authorities, no steps were taken.

Petitioner claims to be bargadar/sharecropper who has been resisted from cultivating the land and the private respondents are trying to change the nature and character of the property which is bound to effect the livelihood of the present petitioner.

State has submitted a report. Report reflects that information was sent to Sutahata Police Station, accordingly, Sutahata Police Station drew a proceedings being Sutahata Police Station NCR No. 540 dated 09.05.2024. It has been categorically stated that there has been no breach of the peace in the area pursuant to the act and action of the petitioner or the private

respondents, a strict vigil has already been kept at the locale.

Learned advocate for the private respondents denies the allegations and further stated that since no affidavits have been called for, the accusations which have been made in the writ petition are deemed not to have been admitted.

Having regard to the contentions of each of the parties, I am of the view that the police authorities have very limited role to be involved. It is directed that in case there is any violation of any law and order, the police authorities would interfere and act in accordance with law.

With the aforesaid observations WPA 16943 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
