The prayer in the writ petition is for a direction on the concerned respondent being the University of Calcutta to dispose of the representation made by the petitioner to the said respondent on 24th August, 2021. According to learned counsel appearing for the petitioner, the petitioner had appeared for the Supplementary Examination, 2019 for B.Sc. Part-I on 20th February, 2020 and had again appeared for the Supplementary Examination on 13th December, 2020. The grievance is that the University has not disclosed the mark sheet of the petitioner for both the supplementary examinations of the Statistics subject.

The petitioner was hence constrained to file an application under the provisions of the Right to Information Act, 2005 for the information.

The University of Calcutta and the State are represented.

There is admittedly no response to the application made by the petitioner on 24th August, 2020 by the University.

Upon considering the materials on record, the University is directed to consider the application of the petitioner dated 24th August, 2020 and pass a reasoned order upon hearing all concerned parties including the petitioner within three weeks from date. A copy of the reasoned order shall be made available to the petitioner within a week from such reasoned order is passed. It is made clear that in the event the University finds that the petitioner has qualified in the supplementary examinations, all consequent benefits shall be given to the petitioner without any further delay.

It is made clear that the court has not gone into the merits of the case.

W.P.A. 17218 of 2021 is disposed of in terms of the above.
