The petitioner seeks consideration of the representation filed before the Sub Divisional Officer, Contai (SDO).

Submission is that the SDO ought to take steps to act in terms of the order passed by the Court restraining any construction to be made.

Learned advocate representing the Panchayat submits, upon instruction that, the construction is being made in accordance with the plan sanctioned.

Without entering into the merits of the claim and counter claim of the parties, the instant writ petition is disposed of by directing the Sub Divisional Officer, Contai to consider and dispose of the legal representation filed on behalf of the petitioners strictly in accordance with law after giving reasonable

opportunity of hearing to all the necessary parties and in line with the order of injunction passed by this Court in WPA 4040 (W) of 2019 (Dilip kumar Giri & Ors -VsThe State of West Bengal & Ors.) by passing a reasoned order at the earliest but positively within a period of eight weeks from the date of communication of this order.

If any unauthorised construction is detected, necessary steps shall be taken to deal with the same in accordance with law.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
