It transpires from the office report that an application for condonation of delay Under Section of 'Limitation Act'

being CAN 9490/2002 was filed before the Hon'ble Court on 01.10.2002 in connection with the instant appeal.

The said application has been dismissed for default vide Order dated 02.08.2022 and after dismissal of the said application for condonation of delay the instant appeal may also be treated as dismissed., In view of the above, it is apparent that the application filed Under Section 5 of 'Limitation Act' in connection with the instant appeal has already been dismissed for default by the Hon'ble Court vide Order dated 02.08.2022.

Accordingly, the instant appeal also stands dismissed.

The department is directed to proceed in accordance with law.
