Rizwan Alam .... for the petitioner Mr. Srijan Nayak, Mrs. Rituparna Maitra .... for the WBSEDCL Learned counsel for the alleged contemnors submits that in the meantime he has handed over documents to his counterpart appearing for the petitioner to indicate that the order of this court was duly complied with by the alleged contemnors by referring the matter to the concerned District Magistrate.

Learned counsel appearing for the petitioner agrees to the said submission. It is also submitted that despite the specific direction of the court for the District Magistrate to decide the matter expeditiously, preferably within eight weeks from the date of reference, the matter has not yet been resolved before

the Magistrate. It is seen from the documents relied on by the parties that the matter was first referred to the concerned District Magistrate on September 27, 2022.

Since the period of eight weeks have elapsed in the meantime and it is submitted by the petitioner that several families are being deprived of electricity due to delay in adjudication by the Magistrate, CPAN 221 of 2023 is disposed of by directing the District Magistrate, Purba Medinipur to decide the reference made by the WBSEDCL in the context of the order dated July 7, 2022 passed in WPA No. 17193 of 2017 as expeditiously as possible in compliance with the observations made in the said order.

The petitioner is granted liberty to communicate a server copy of this order along with a fresh server copy of the order dated July 7, 2022 on the District Magistrate, Purba Medinipur to ensure compliance of this direction by the District Magistrate at the earliest. (Sabyasachi Bhattacharyya, J.)
