Banerjee) Mr. Subrata Mukhopadhyay Ms. Basabi Roy Chowdhury Ms. Kakali Dutta ... for the petitioners Mr. Avishek Prasad ... for the State Mr. Ratul Biswas Mr. Kaushik Chowdhury ... for the DPSC, Howrah Mr. Rabindra Nath Pal Mr. Kaustava Ratan Chatterjee ... for the DPSC, Jalpaiguri It appears from the report filed by the District Primary School Council, Howrah that the petitioner no. 1 obtained 45% in Honours Category (this petitioner Bijon Singh @ Bijon Kumar Singh is a Reserved Category Candidate) and that is why he was not called despite having B.Ed qualification as B.Ed must have 50% in the graduation level examination for the General Category and 45% for the Reserved Category candidates. However, from a memorandum issued by the West Bengal Board of Primary Education dated 07.10.2022 it is found that the Board has declared that "in case of Honours Graduates the candidates having 50% marks as a whole (marks obtained in Honours

papers + Pass papers) in Graduation having B.Ed. training qualification are eligible to apply for TET-2022 through online portal."

I direct the DPSC, Howrah to reconsider the matter after giving an opportunity of hearing to the petitioner no. 1, namely Bijon Singh @ Bijon Kumar Singh and consider his case for appointment as appears from page 51 of the writ application.

The grievance of the second petitioner (namely, Mantu Hazra) is against the District Primary School Council, Jalpaiguri and, therefore, I am not hearing this matter as Circuit Bench in Jalpaiguri has the appropriate determination to take up this matter. Therefore, the petitioner no. 2 is granted liberty to file his case before the said Circuit Bench and no order is passed in respect of the petitioner no. 2 in this matter.

The DPSC, Howrah will consider the case of the petitioner no. 1 after giving him an opportunity of hearing within a period of four weeks from today, i.e., by 23rd December, 2022.

With the above direction this writ application, so far as the petitioner no. 1 is concerned, is disposed of. (Abhijit Gangopadhyay, J.)
