Galib Mr. Gourav Das ... for the State The petitioner prays for a direction upon the District Inspector of Schools to take a decision with regard to the approval of the panel of Assistant Head Master of Dhuliyan High Madrasah which was submitted by the Madrasah to the District Inspector of Schools on 22nd/23rd February, 2021.
The learned advocate representing the District Inspector of Schools submits, upon instruction, that there were certain illegalities in the selection process. The matter has been referred to the higher authority.
Be that as it may, law requires that a decision is required to be taken by the District Inspector of Schools within a period of 30 days from the date of receipt of the panel.
In the instant case the panel was prepared in February, 2021 and till date the District Inspector of Schools has not communicated the decision to the concerned Madrasah.
In that view of the matter the instant writ petition is disposed of by directing the District Inspector of Schools, Secondary Education, Murshidabad being the respondent No. 3 herein to take a decision with regard to the panel which was prepared for appointment of Assistant Head Master of the High Madrasah strictly in accordance with law, at the earliest, but positively within a period of four weeks from the date of communication of a copy of this order.
The aforesaid respondent shall pass a reasoned order and communicate the same to all the parties.
It is made clear that this court has not entered into the merits of the panel and all points are left open to be decided by the District Inspector of Schools at the time of consideration of the panel.
The writ petition stands disposed of.
