It is submitted on behalf of the petitioner that the plot in question which was owned and occupied by the petitioner was acquired by the State authorities for the purpose of construction of road over bridge and compensation was paid to the petitioner in respect of the land and structure thereon.

The petitioner raised objection to the quantum of the said compensation and in response to the petitioner's representation dated 13th September, 2018, the concerned authority conducted a joint measurement and revalued the compensation payable to the petitioner for the structure. The petitioner has taken the Court to Annexure P-11 to the writ petition which is a letter issued by the Executive Engineer to the Special Land Acquisition Officer, Purba Bardhaman on 20th March, 2020 recommending

disbursement of balance amount of compensation to the petitioner. The petitioner complains that he is yet to receive the balance amount.

The petitioner submitted a representation before the concerned authority on 12th June, 2021 ventilating his grievance, but such representation is yet to be considered. The petitioner prays for a direction upon the authority to consider the said representation at the earliest. Learned counsel for the State also submits that the representation may be considered by the authority on merits.

Upon consideration of the submissions made on behalf of the parties, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the representation submitted by the petitioner dated 12th June, 2021, within a period of two months from the date of communication of this order after granting reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law. With the above observations and directions this writ petition being WPA 17245 of 2021 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
