The instant revisional application is filed against an order of issuance of warrant of arrest by the Trial Court on 6th January, 2021 for non-payment of arrear maintenance amounting to Rs.1,97,000/-. The petitioner has filed an application for extension of interim order on the ground that he has already paid a sum of Rs.40,000/- and he will pay another Rs.40,000/- by the next week.

I have heard the Learned Advocate for the petitioner. It is already recorded that Rs.1,97,000/- is due towards payment of maintenance allowance from the petitioner. The petitioner being the husband of the opposite party is obviously refusing and neglecting to maintain his wife/opposite party and his conduct is apparent because the petitioner is accepting this Court as a means to drag and delay payment of arrear maintenance.

The petitioner is directed to deposit the entire arrear amount within 8th July, 2022 in the Trial Court and if such payment be made the Learned Trial Judge shall recall the warrant of arrest. After passing the order nothing remains in the instant criminal revision and accordingly, the instant criminal revision is disposed of on contest on the basis of the above order and direction.

Let a plain copy of this order duly certified by the Assistant Court Officer be sent to the Learned Court below for information and compliance.
