This is an application under Article 227 of the Constitution of India against the order dated 22.9.2021 passed by the learned Chairman, Municipal Building Tribunal in B.T. Appeal No.27 of 2021.

By the impugned order, learned Building Tribunal was pleased to dismiss the application dated 16.9.2021 filed by the appellant/petitioner wherein the petitioner had prayed for stay of operation of the order dated 09.9.2021. Having considered the facts and circumstances of the case, the Chairman, Municipal Building Tribunal is hereby directed to dispose of the B.T. Appeal No.27 of 2021 within a period of six months without granting any unnecessary adjournment to either of the parties.

Let there shall be an order of stay of order for demolition of construction in connection with premises no.T/14N/1D, Dum Dum Road, Kolkata-700030, Ward No.3, passed by Executive Engineer (Building), Brough No.1

in the Demolition Case No.041-D/B/I/21-22 for a period of six months, or till disposal of the appeal whichever is earlier. Accordingly, C.O. 1874 of 2021 is disposed of. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
